Monday, the CFPB used an interim final rule (IFR) to address certain debt collector conduct associated with the COVID-19 pandemic temporary eviction moratorium issued by the CDC. Effective May 3rd, the IFR requires debt collectors, as defined in the FDCPA, to provide written notice to certain consumers of their protections under the CDC Order’s eviction moratorium and clarify that certain misrepresentations are prohibited.
The Bureau has published a ‘Fast Facts Summary’ and Sample Disclosure Language related to the IFR, which can be found here.
You can access the Interim Final Rule here.
CCI suggests our clients share this information with their third-party service providers that fall under the FDCPA’s definition of a debt collector.
Sincerely,
Sarah Smith, CRCM, CAFP
